1. Acceptance of terms
By accessing or using the Local Jam platform (“Service”) at localjam.live, you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, you may not use the Service. These Terms apply to all users, including musicians, bands, venues, and listeners.
2. The Service
Local Jam is an online platform connecting musicians, bands, venues, and music lovers. It enables users to create profiles, discover local talent, post and apply for gigs, and communicate directly. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
3. Accounts
- You must be at least 16 years old to create an account.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
- You must provide accurate and complete information when registering.
- You may not create more than one account per person for deceptive purposes.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable use
You agree not to use the Service to:
- Post false, misleading, or fraudulent content.
- Harass, abuse, threaten, or discriminate against other users.
- Spam or send unsolicited messages.
- Infringe intellectual property rights of third parties.
- Upload malware or attempt to compromise the security of the platform.
- Scrape, crawl, or systematically extract data without our written permission.
- Violate any applicable law or regulation.
Violations may result in immediate account suspension and, where applicable, reporting to law enforcement.
5. User content
You retain ownership of any content you post on Local Jam (profile photos, bios, media links, messages). By posting content, you grant Local Jam a non-exclusive, worldwide, royalty-free licence to display and distribute that content as necessary to operate the Service. You represent that you have the rights to share any content you post.
We do not review all content in advance but reserve the right to remove any content that violates these Terms or applicable law.
6. Gigs and opportunities
Local Jam is a platform for connecting parties — we are not a party to any agreement made between users. We make no representations about the accuracy of gig listings, the reliability of users, or the outcome of any arrangement made through the platform. Users are solely responsible for verifying the legitimacy of gigs and agreeing on terms independently.
7. Intellectual property
The Local Jam name, logo, design, and underlying platform code are the exclusive intellectual property of Local Jam. You may not copy, reproduce, or use them without prior written consent.
8. Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
9. Limitation of liability
To the fullest extent permitted by law, Local Jam shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of — or inability to use — the Service. Our total liability for any claim arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.
10. Termination
You may delete your account at any time. We may suspend or terminate your access if you breach these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimer, limitation of liability) will survive.
11. Governing law
These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Netherlands, without prejudice to your rights as a consumer under applicable EU law.
12. Changes to these Terms
We may update these Terms from time to time. Significant changes will be communicated by email or a notice on the platform at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
